GlobalParts Automotive
1. The consumer and/or business customer may only derive rights if it can be proven that the goods were purchased from GlobalParts Automotive. Such proof may be provided by submitting the relevant purchase agreement and/or invoice.
2. Rights of the consumer and/or business customer arising from these Terms & Conditions are not transferable to third parties.
3. GlobalParts Automotive guarantees the soundness and usability of the supplied goods for a period of three (3) months from the date of purchase. If a defect becomes apparent within this period, the consumer and/or business customer is entitled to offer the delivered goods to GlobalParts Automotive for repair or replacement, at the discretion of GlobalParts Automotive, in accordance with the applicable General Terms and Conditions. Proof may be provided by submitting the relevant work order and/or invoice.
4. If the conditions set out in Article 3 of these Terms & Conditions and the applicable General Terms and Conditions are met, GlobalParts Automotive undertakes to repair or replace the offered goods within a reasonable period with comparable goods. If this is not possible, GlobalParts Automotive shall refund the relevant invoice amount.
5. Goods received by the consumer and/or business customer after repair or replacement are again eligible for the basic warranty (or until the end date of the original extended warranty, if applicable).
6. The consumer and/or business customer cannot make any claim if incorrect or insufficient information has been provided regarding the brand and type designation of the purchased goods and/or the vehicle for which the part is intended.
7. Any obligation of GlobalParts Automotive lapses if the consumer and/or business customer fails or has failed to meet their payment obligations in a timely manner. The consumer and/or business customer is not entitled to withhold payment on the grounds that obligations have not yet or not fully been fulfilled.
8. Excluded from any claim are defects in materials or components prescribed or supplied by the consumer and/or business customer.
9. Excluded from any claim are defects in installed electronic components.
10. Excluded from any claim are defects in fuel systems if the fuel tank and additional components have not been flushed and/or replaced. Claims are also excluded for engine damage resulting from the use of fuels for which the engine is not suitable according to factory specifications.
11. Engine damage resulting from failure and/or incorrect use of electronic components and/or related electronic systems is excluded.
12. Excluded are defects that are not material and/or construction defects, including but not limited to defects caused by normal wear and tear, internal or external contamination, corrosion, paint damage, transport, freezing, overheating, overloading, and/or dropping of the product.
13. Any claim is excluded if parts other than those prescribed by the manufacturer were used during installation.
14. Any claim is excluded if non-original parts were used during installation.
15. Any claim is excluded if the purchased goods are installed in a vehicle for which they were not originally intended.
16. Any claim is excluded if the purchased goods are installed in a sports car or a modified or tuned vehicle.
17. Defects resulting from intent, failure to perform normal or prescribed maintenance, incorrect installation, connection or modifications by third parties, improper handling, or abnormal use are excluded.
18. No claim exists for defects arising from accessories related to the goods but not inspected by GlobalParts Automotive, nor for defects or damage resulting from participation of a vehicle in races or speed trials.
19. Claims relating to engines and/or gearboxes apply only if it can be demonstrably proven that oil, timing belt and/or filters have been replaced.
20. No claims are accepted for work and/or parts relating to installation.
21. Any breach of any other provision of the applicable General Terms and Conditions or these Terms & Conditions, where such provisions are stipulated under penalty of forfeiture of rights, shall result in the loss of any claim.
22. The consumer and/or business customer cannot derive any right to compensation of any kind from these Terms & Conditions, except insofar as GlobalParts Automotive is legally obliged to do so under applicable law.
23. GlobalParts Automotive reserves the right to deviate from these Terms & Conditions if the consumer and/or business customer has been explicitly informed thereof prior to concluding the purchase agreement and such deviations have been recorded in writing between GlobalParts Automotive and the buyer.
24. Parts that are specially ordered or specially dismantled will not be accepted for return.
25. Parts that are specially ordered based on a specific part number will not be accepted for return.
26. GlobalParts Automotive is not liable for incorrectly made diagnoses and will not accept returns on this basis.
27. Shipping costs are always borne by the customer.
28. Transport costs for vehicle collection and/or delivery will not be reimbursed under any circumstances.
29. Labor costs will never be reimbursed.
30. The part must be fitted with an identification mark applied by GlobalParts Automotive, including the date of purchase.
31. In the event of a demonstrable and proven defect, the part will be exchanged for a comparable and equivalent part.
32. Only if no comparable and equivalent part is available in stock may the buyer be entitled to a refund of the purchase price.
33. These Terms & Conditions apply to both consumers and business customers, unless mandatory law provides otherwise.
